This Acceptable Use Policy ("AUP") forms part of the Terms of Service and applies to everything you do through varg.ai, including via our API, SDK and any automated agent acting on your behalf. Breaching it may result in immediate removal of content, suspension or termination without refund, and referral to law enforcement.
1. Prohibited content
Do not use the Services to generate, upload, store, request or distribute content that:
- sexualises a minor in any way, or constitutes child sexual abuse material (CSAM);
- is intimate, sexual or nude imagery of a real identifiable person created or shared without that person's consent (non-consensual intimate imagery, "NCII");
- depicts a real identifiable person — their face, body, voice or performance — without that person's documented consent, or in a way that would deceive a reasonable viewer about what they said or did;
- impersonates a person, brand, public official or organisation, or falsely suggests endorsement or affiliation;
- promotes, incites or facilitates violence, terrorism, violent extremism, or self-harm;
- harasses, bullies, threatens, defames, or degrades a person or group;
- incites hatred or discrimination on the basis of race, ethnicity, national origin, religion, disability, sex, gender identity or sexual orientation;
- facilitates fraud, scams, phishing, spam, market manipulation, or deceptive advertising;
- gives instructions for weapons, explosives, controlled substances, or other activity likely to cause serious harm;
- contains malware or is designed to compromise a system;
- is designed to deceive voters or misrepresent electoral processes, candidates or officials;
- infringes intellectual property, or violates privacy, publicity, personality or data protection rights;
- is otherwise unlawful in a jurisdiction where you operate or distribute it.
2. Likeness, voice and consent
Our tools can produce convincing depictions of people. If you generate content featuring a real person you are solely responsible for holding, and being able to evidence, every necessary right: a written release covering likeness and voice, consent under applicable biometric and data protection law, and any union, talent or brand permission. Never upload a photograph, recording or voice sample of someone who has not agreed to its use here. Never depict a person in a sexual, criminal, medical or political context they have not agreed to. Never depict anyone under 18 in any sexualised context, real or synthetic.
3. Prohibited conduct
- circumventing or attempting to circumvent moderation, safety systems, rate limits, quotas, credit accounting, geographic restrictions or access controls;
- using Outputs to train, fine-tune, distil or evaluate a competing model or service, or scraping the Services other than through our API and SDK;
- probing, scanning or testing the security of the Services without our prior written permission, or accessing data that is not yours;
- sharing credentials, creating accounts to evade suspension, or abusing trials, promotions or credit grants;
- reselling, sublicensing or white-labelling the Services without our written consent;
- any use that interferes with the integrity or performance of the Services or the rights of other users.
4. Third-party model rules also apply
Requests are executed by third-party model providers listed in our Subprocessors page. Their own usage policies apply to you in addition to this AUP, and some restrict commercial use or the depiction of real people more tightly than we do. Where they conflict, the stricter rule governs.
5. Reporting
Anyone — user or not — may report content or conduct that breaches this AUP or applicable law by emailing hello@varg.ai. This is our point of contact for notice and action, including under the EU Digital Services Act. Please include a link or identifier for the content, an explanation of why it is unlawful or infringing, your contact details, and a statement that your report is accurate and made in good faith.
Urgent categories. Mark your subject line CSAM or NCII for reports involving child sexual abuse material or non-consensual intimate imagery. We prioritise these, act to remove verified material without delay, and preserve and report as required by law. Copyright complaints follow the DMCA process in Section 8 of the Terms of Service.
We acknowledge reports, tell the reporter the outcome where we have their contact details, and notify affected users of removals and suspensions unless doing so is unlawful or would prejudice an investigation.
6. Enforcement
We may investigate suspected breaches and may remove or restrict content, limit features, suspend or terminate accounts and API keys, withhold or forfeit credits, and report to law enforcement or the relevant authority. Where we obtain actual knowledge of apparent child sexual abuse material we preserve and report it to the National Center for Missing & Exploited Children as US law requires. We are not obliged to monitor content and do not undertake to do so; enforcement is at our discretion and no action or inaction waives any right.
If you believe enforcement action against your account was mistaken, write to hello@varg.ai and we will review it.
